What Section 3 is
Section 3 of Amazon's Business Solutions Agreement, the contract every seller accepts, covers term and termination. It lets Amazon suspend or terminate an account immediately when it determines a seller has materially breached the agreement, or that an account may be used for deceptive, fraudulent, or illegal activity. Amazon doesn't have to prove wrongdoing the way a court would. Its own review, including automated signals, is enough to act.
Common triggers
- Inauthentic or counterfeit complaints, especially repeated ones or ones Amazon couldn't resolve with your documents
- Links to another suspended account, including through a shared device, address, bank account, or person
- Suspected fraud or misrepresentation, such as documents Amazon believes were altered
- Review, coupon, or promotion abuse
- Repeated policy violations after earlier warnings
Why it's harder than a normal deactivation
A routine deactivation usually comes with a clear list of what to fix. A Section 3 notice often doesn't. The appeal path can be less obvious, funds are more likely to be held, and a weak first appeal can lead to a final decision. That's why the response needs more investigation and less writing.
How to respond
- Find the real cause. Pull every notification, check for linked accounts, and review any documents you've submitted before. The stated reason is not always the whole story.
- Collect evidence first. Supplier invoices, business records, proof of identity, and proof you don't control any linked account, depending on the trigger.
- Write a specific Plan of Action. Root cause, what you've already changed, and what will prevent it from happening again. Generic apology letters fail here more than anywhere.
- Escalate carefully. If the standard appeal path is closed, there are escalation routes, but they work best with a clean, well-documented case.
Don't submit a quick appeal to a Section 3 notice. Send us the notice first. We'll tell you honestly whether the case is recoverable and what it would take.
